The Current Situation Of Family Violence Legislateon In China

On March 1,2016, the first anti-family violence law " the People's Republic of China on anti-family violence law" effected. The law stipulates clearly the meaning of domestic violence, domestic violence prevention and treatment work, personal safety protection, legal liability, etc. The anti-family violence law system include anti-family violence law of the People's Republic of China, the law on public security administration punishments, civil law and criminal law. This paper introduces the content of the legal system, and proposes some problems that exist in the legal system. This article is divided into four parts, the first part is based on the domestic and foreign law to explain the meanings of family violence, including the basic meaning of domestic violence and the characteristics of the domestic violence, mainly from the subject, object, behavior of domestic violence, the degree of harm done to the domestic violence simple analysis. The second part, introduced the existing laws of China about family violence, including administrative, civil and criminal liability of domestic violence. The third part found and analyzed the problem in existing laws against domestic violence in our country. The fourth part to draw lessons from the successful experience of countries and regions of the domestic violence legislation in order to perfect our country's anti-domestic legal system. The fifth part is based on the above content to put forward personal opinions. This paper is on the basis of successful experience of other countries, with the method of theoretical analysis and practical research, reviewing the existing law against family violence in our country.In order to analyze the deep problem of domestic violence, and provide valuable reference.
