Research On The Legal Issue Of The Recovery Of Escaped Corruption Asset

As China takes efforts to further enhance the anti-corruption,the mechanism of the recovery of corrupt assets has become a crucial issue. Most corrupt officials transfer their proceeds of crime and other illegal income overseas, which brings huge losses,and does harm to the peaceful development between China and the asset recipient country. In the face of the relocation of the corrupt assets,to improve the efficiency of the recovery of corrupt assets.China needs the cooperation with the assets recipient country in the recovery of corrupt assets.Due to the variation in domestic law, in the practice of bilateral treaties and conventions, it will inevitably bring obstacles to the recovery of corrupt assets. Although China is a member of the United Nations Convention against Corruption, but the application of the United Nations Convention against Corruption will often confronted with some practical problems.In this thesis,the studying object is the existing problem on China's legal provisions of the recovery of corrupt assets. According to the relevant provisions in the United Nations Anti Corruption Convention, combined with the difficulties confronted in the recovery of corrupt assets some proposals are put forward.
