The crime of corruption as the extreme form of bartering, has a long history.Corresponding to this is official corruption flight and corruption of cross-border asset transfer,with the development of economic globalization, the weakening national control on economy,society, the crime of corruption is the trend of globalization and internationalization,multinational and foreign characteristics significantly. Corrupt officials abscond abroad or in China, through money laundering, cash smuggling and so on corruption assets is transferred to the outside, become some corrupt officials of the modus operandi. These crimes seriously affect the social and economic development of our country. Our country although with some countries signed the relevant asset recovery of the relevant treaty, but in cases of practical application due to the different national conditions, political position and different provisions of the domestic law different, international cooperation against corruption in conjunction with still difficult. This dissertation to corrupt the cross-border asset recovery related problems as the analysis object, first of all to typical cases into theme, through the case analysis of international how to cooperate and which use the specific ways, and to the United Nations Convention against corruption perspective through to investigate corruption assets cross-border transfer and cross-border recovery overview of and analysis of corrupt assets directly recovery mechanism, the indirect recovery mechanism, asset return and disposal and running effect of, and our country to the Convention of the position and practice. The obstacles faced by our country currently faces of the urgency of the situation and international collaboration to identify cross-border corruption assets recovery, based on proposed corresponding suggestions, and actively, to maximize to achieve a variety of recovery measures with the value.
