As a new agricultural management main body,the family farm is an important direction of the development of agricultural modernization in China.But due to China's relevant legal system construction lag and other reasons,resulting in legal status is not clear,land property right is not clear,many problems of land transfer and financing difficulties has been hampered by the further development of family farms in China business model.And development of family farm business model in Japan,the United States,France and other countries the most representative,the three countries respectively to their own national conditions as the basis,give full consideration to the characteristics of the national resources and level of technological development,according to the needs of economic development,the timely adjustment of the relevant laws and regulations and finally the successful construction of the modern family farm business model.Therefore,it is of great significance.In this case,to the United States,France and Japan family farm legal system as the research object,the integrated use of literature,comparative analysis,empirical analysis and other research methods,to the United States,France and Japan family farm produce and development,legal system construction and other conditions were discussed and the comparison,summed up the successful experience of the developed country family farms in the construction of legal system,and then established the construction of family farms in China legal system should uphold the concept,should adhere to the guiding ideology and the principle of internationalization and localization of the boundary,and then from the solution of China's land rights,improve the land transfer system,put forward specific suggestions to improve China's legal system of family farm legislation perfect financing legislation and selection aspects of family farm.Hope to provide theoretical support and practical support to the further development of family farms in our country through the related research.
