Research On Obligation In Protection Of Personal Information Held By Administrative Organs With Japan Act On The Protection Of Personal Information Held By Administration Organs As A Focus

Recently because of the rising of the concern of the personal information,the study of the personal information is also flourish.The scholars usually focus on the private law,concentrating on the collection and use of the personal information,but they are rarely concerned of the public law.As we all know,the administration need cope with so many official business that they must use vast personal information.So if the personal information is revealed,it may cause the bigger danger.The Act on the Protection of Personal Information Held by Administration Organs has been published in 2005,it has the significance for our legislation by studying the law.So this paper's purpose is to give our legislation some advice by studying the law,basing on the administrative laws and regulation,in order to achieve the goal of making citizens' basic rights.The first chapter is to introduce background of the Act of on the Protection of Personal Information Held by Administration Organs,and its purpose,in order to clear the concept of personal information in Japan,and its theory of law.The second chapter is to introduce the restriction of the administrative organs so as to obligation of the administrative organs when they take use of the personal information they hold.The third chapter is to introduce the right of the party and the exception,in order to clear the balance of right of the party and public interest.The forth chapter is to the relief measure and supervision system in the law,emphasize the Information Disclosure and Personal Information Protective Review Board system.By introducing this system,give our supervision system inspiring and learning.The last chapter is to give our legislation some advice,by comparing China and Japan's law,glancing the current status of our legislation.
