| Today,the development of internet has caused many problems.This thesis is based on the case study of QVOD company was committed crime of spreading pornographic articles to make a profit.The author focuses on the identification of pornographic articles and related behavior in spreading such articles to make a profit by analyzing three disputes of this case.The most important part of this essay is chapter three to chapter five.I do research on crime which is about crime of spreading pornographic articles to make a profit.About the part of identification of pornographic.I do research on laws about this problem.The main question in this case is whether electronic obscene information is equivalent to pornographic articles in the criminal law,because there are many legal cases which relate to this problem.The electronic obscene information is different from the traditional entity objects,so this it is worthwhile to discuss such question.About the part of elated behavior in spreading such articles to make a profit by analyzing three disputes of this case.Firstly,the identification of propagation behavior is interpreted from information dissemination aspect which includes two essential factors(audience and media).These two factors create indispensable condition for information dissemination behavior.Secondly,the thesis discusses whether the fragmented files in network players belong to the category of dissemination are.Finally,the author discusses whether the QVOD knew its crime behavior and did it to make a profit on purpose and talk about the main purpose which can help distinguish crime of spreading pornographic articles to make a profit and other crimes about internet eroticism. |
