| The system of the procuratorial organ initiating environmental civil public interest litigation has been established in our country,the prosecution status of the procuratorial organ has been further strengthened;however,we must recognize the role of prosecutors has a complementary nature in environmental civil litigation in,he is not a substitute for social organizations and civil;learning from the successful experience of foreign procuratorial organs and part of our practice,we can find that the current system of operation of our country there are still many deficiencies and the lack of good place;the core issue is the main dilemma,wcich is how to solve the conflict of multiple identities of procuratorial organs;There are also many problems of operation system and specific operating procedures;in order to more fully protect the environment public interest,it is necessary to improve the system from the three aspects of operational procedures,subject,operating system;wo need rationally understand the double identity of the procuratorial organs,recognite the right position of the procuratorial organs through legislation;at the same time on the operating system and operational procedures,adding some details.in order to improve the system construction of China’s procuratorial organs initiatig environental civil public litigation. |
