Research On Problem Of Public Security Administrative Reconsideration

From the perspective of "good governance",under the background of the innovation of social governance,social contradiction presents a trend of sudden and multiple,and various administrative disputes have emerged and concentrated.Administrative reconsideration,as an important means of handling administrative disputes and resolve contradictions,under the background of social governance innovation plays a great role,and the public security administrative reconsideration organ as a main body of the social comprehensive governance,their function and execution is closely related to the social stability and the national long-term peace and good government.From the perspective of "Rule by law",The fourth Plenary Session of the 18th CPC Central Committee puts forward new requirements for comprehensive governing the country according to law,improve the system of public security administrative review,promote the public security administrative reconsideration programmed and standardization,is one characteristic of rule of law in an all-round way.Currently,there are many deficiencies and defects in Shanxi L municipal public security administrative reconsideration,has been unable to meet the needs of economic and social development,but also can not protect the legitimate rights and interests of the administrative counterpart.Therefore,in view of the objective existence of the violation of administrative law and tort sometimes occur,a perfect administrative reconsideration system and administrative reconsideration procedure is particularly important,only in this way can we prevent the abuse of power,and the public security administrative power supervision and restraint,to maximize the protection of the administrative relative person legitimate rights and interests.Based on problem oriented thinking,analysis and put forward the existing problems and Countermeasures of public security administrative reconsideration,it becomes the problem that we want to study and discuss.The framework of this paper mainly includes five parts:The first part is introduction.This paper mainly introduces the background of the topic,the purpose of the topic,the domestic and foreign research review,the main research methods.The first chapter is overview of the relevant theory.Interpretation of the meaning of the public security administrative reconsideration,the contents of the public security administrative reconsideration,the principle of public security administrative reconsideration,the necessity of public security administrative reconsideration and the theoretical basis of this paper.The second chapter is current situation and problems of the public security administrative reconsideration of L city in Shanxi province.This paper mainly discusses the main practice and achievements of public security administrative reconsideration in L city of Shanxi Province,as well as the problems existing in the administrative reconsideration of public security administrative reconsideration in the scope of reconsideration,the reconsideration procedure and the connection of administrative reconsideration and administrative litigation.The third chapter is the reasons of existing problems of public security administrative reconsideration in L city.Analyze in-depth reasons for the existing problems of public security administrative reconsideration in L city from four aspects:the ideological understanding,administrative reconsideration procedures,regulatory system and administrative reconsideration system.The fourth chapter is countermeasures to improve the public security administrative reconsideration of L city in Shanxi province.Aiming at five aspects of public security administrative reconsideration problems,interface from the environment construction of administrative reconsideration,administrative reconsideration and administrative litigation,administrative reconsideration results,administrative reconsideration oversight mechanisms and administrative reconsideration system put forward countermeasures and suggestions.
