The development of medical and health services is closely related to people's life and health. In recent years, the contradiction between doctors and patients in China is prominent, from time to time there will be medical incidents of violence. One of the important reasons is that the medical corruption caused by the "medical treatment is difficult, expensive", which cause strong dissatisfaction with the people. Although many years ago, the crime of commercial bribery, of course including the bribery crime in medical drug purchase, has aroused great attention of the Chinese government, and has been cracking down on, from the point of view of judicial practice, corruption cases in the field of health care is still prone to multiple. As an engaged in anti-corruption work, I have witnessed and personally involved in investigating corruption and bribery cases in medical and health field, hoping that through a combination of practice to make a research in this aspect, and hope it will be helpful to create a healthy and positive medical environment and build a harmonious doctor-patient relationship. This paper takes the empirical analysis as the starting point and the foothold. The first part, randomly select 100 medical and health field of corruption and bribery cases that have been tried in court in recent years, then analyze the crime of bribery and corruption charges distribution, and characteristics of crime incidence areas. The second part, combined with the judicial practice and real cases, analyze the causes of crime from the system mechanism, legislation and judicial aspects. The third part, on the basis of the first two parts, from the sound system mechanism, improve the relevant legislation, strengthen the judicial response and other aspects of the proposed measures.
