As an independent and permanent international judicial institution,the International Criminal Court(ICC)determined to put an end to the impunity for the perpetrators of the most serious crimes which concern to the international society as a whole,and thus contribute to the peace,security and well-being of the world.However,all situations where investigations have been formally opened by the ICC since its establishment in July 2002 originated in the African continent,with only one exception of Georgia.This led to fierce criticisms from the African states in relation to the court's fairness.The deterioration relations between the two came to the head when the African states completed their‘trilogy' against the ICC.The thesis aims to analysis the reasons why the ICC targeted the African and whether it was unfair.In addition,the discussion also goes to the cause of the African's changing altitude from active supporter to strong protestor.Finally,the way by which the ICC could get out of the trouble is examined.The thesis concluded that the shared goals of justice and peace revealed the existence of foundations for their cooperation.However,in face of the legal and political challenges of the ICC,efforts to improve the relations with the African states should focus on problem-solving and the adoption of positive complementary principle.
