The Research On Legal Issues Of Sub-delegation In Marine Freight Forwarding

At present,the legal behaviors of the sub-delegation in marine freight forwarding is widely used,and the legal conflicts involved in it also increase.Given the fact that the legal system of Chinese marine freight forwarding has close connections with the freight forwarding system in common law system and the sub-delegation legal system origins from civil law system,there exists issues of corporation and cohesion.On the contrary,the currently legal provisions relating to freight forwarding in our country is not effective and can not resolve the practical issues entrusted by the legal conflicts.With respect to such issues,this paper focus on the legal system of marine freight forwarding,elaborating the legal basis,legal status of the parties and responsibilities of the concerned parties respectively,in order to construct the legal system of sub-delegation in marine freight forwarding.Chapter 1 defines and states the study subject,based on the definition of contemporary concepts and behavioral types of marine freight forwarding,this paper elaborates the scope and types of the sub-delegation in freight forwarding.Chapter 2 defines the legal characters of sub-delegation in marine freight forwarding,by using the theories of agency and delegation.This chapter analyzes the defects of Chinese judicial interpretation in defining the legal characters,and presents tow criteria in elaborating the legal characters,and finally summarizes different types of legal characters of sub-delegation in marine freight forwarding.Chapter 3 establishes the legal status of the parties in sub-delegation,on the analysis of different types of legal status,this chapter provides a clear judgment on judging the legal status of the related parties,and analyzes the special conditions of such status.On the basis of Chapter 3,chapter 4 presents the types of legal liabilities of the parties in sub-delegation,and analyzes certain special conditions.
