The Research On Legal Issues Of Sub-delegation In Freight Forwarding

At present,the legal behaviors of the sub-delegation in marine freight forwa-rding is widely used,and the legal conflics involved in it also increase.Given t-he fact that the legal system of Chinese marine freight forwarding has close co-nnections with the freight forwarding system in common law system and the sub-delegation legal system origins from civil law system,there exists issues of cor-poration and cohesion.On the contrary,the currently legal provisons relating to freight forwarding in our country is not effective and can not resolve the practic-al issues entrusted by the legal conflicts.With respect to such issues,this paper focus on the legal system of marine freight forwarding,elaborating the legal ba-sis,legal status of the parties and responsibilities of the concerned parties respe-ctively,in order to construct the legal system of sub-delegation in marine freight forwarding.Chapter 1 defines and states the study subject,based on the definition of co-ntemporary concepts and behavioral types of marine freight forwarding,this pap-er elaborates the scope and types of the sub-delegation in freight forwarding.Chapter 2 analyzes the status of the legislation of the freight forwarders in China and the current situation of the judicial trial,and finds out two problems arising from the sub-delegation of the freight forwarders in China.One is that th-e relevant legislation is imperfect and the other is unclear.Chapter 3 analyzes the inherent legal relationship of freight forwarders,and divides the legal relationship of freight forwarders into two types:sub agency an-d factor.Chapter 4 improves the freight forwarder's fault presumption system by perf-ecting the legal norms of freight forwarding entrusted behavior and perfecting the problems arising from the behavior of China's maritime freight forwarders.
