Study On Regulations Of Criminal Laws On Internet Rumors In Transformation Period

Internet rumor is an objective reality,and also the inevitable outcome of internet development.Internet communication share characteristics of both traditional one-way mass communication and two-way interpersonal communication,and its speed and breadth are hence greatly improved due to the virtualization and concealment.As a result of anonymity of internet communication,the internet rumor is hardly traced and controlled,and will do great harm to the society.In the social transformation period coupled with complex social contradictions,the prevalence of internet rumors will disrupt social order,and infringe upon the rights of other people as well as the legal system.At present,there are still many deficiencies in the law for regulating criminal activities of internet rumors,such as incomplete charging system,ambiguous standards,and unreasonable crime determination.Under the situation of social transformation,it is of theoretical and practical significance to discuss the legislative and judicial issues in the governance of internet rumors.By utilization of documentary,theoretical and interpretive research methods,this paper made a theoretical analysis of internet rumors,and sorted out relevant"interpretations" on internet rumors made by the Supreme People's Court and the Supreme People's Procurator ate.By analyzing the current situation and problems of criminal law in the regulation of internet rumors from the aspects of legislation,judicial interpretation and judicial practice,this paper proposed some countermeasures in response to the new situation of social transformation period.This paper is mainly divided into five parts:The first part of introduction mainly discussed the research background,significance,research status,as well as the research methods and its innovations.The second part studied the basic theory of criminal law regulations on internet rumors,discussed the concept and characteristics of the internet rumors,and elaborated on crime determination and relevant regulations on internet rumors by the criminal laws.The third part studied the particularity of regulation on internet rumors by criminal laws,analyzed the features of internet rumors in the social transformation period,elaborated on main problems and harms.The forth part studied the status quo and problems of regulations on internet rumors by criminal laws in social transformation period,summarized the legislation process and defects from the perspective of legislation and judicial interpretations.Meanwhile,this part discussed the problems and difficulties in the judicial practice on internet rumors..The fifth part,in response to problems of social transformation period,put forward the countermeasures for improving criminal regulations on internet rumors from aspects of legislation,judicial interpretation and judicial practice...
