A Study On The Criminal Law Of Network Rumors

Along with the rapid development of science and technology, also getting further development of network technology, to a certain extent, and then the development of internet rumors, as we know, people can work, communicate with friends, entertainment and speak freely, publish or forward all kinds of information of true or false in the network space, so network instead of traditional way of rumors, become a new way of rumors. And on the extent and depth of it, falsification and propagation of internet rumors also reaches an unprecedented level, the influence of rumors has also been gradually expanded, and may have serious crisis of confidence and realistic social risk. In this background, the Supreme People’s Court and the Supreme People’s Procuratorate jointly issued "judicial interpretations" on September 9, 2013. It criminates about using of the Internet rumors implementation related crime, explicitly stipulates about including in the scope of criminal law adjustment and designates the legal bounds of network speech. In this paper, as an example of "Qin fire fire weibo rumors" case, "two down four weibo rumors" case and "weibo rumors to people" case, discusses contending focus through the analysis of the case, and then solves them one by one by using the combination of professional theory knowledge to the related literature. Finally, combining with the enlightenment of governance network rumors from this case study, and then raise relevant suggestions in order to control the improvement of internet rumors from the theory and practice in the future.
