Research On The The Legal Regulation Of Children's Drug Safety In China With A Perspective Of Improvement Of "Drug Administration Law"

Drug treatment is one of the main means of treating children's disease.The safety of children's medicines is related to children's life and health.At present,China's children's drug safety accidents frequently lead to damage to children's life and health rights.Children's drug safety has caused a widespread concern in the whole society.Children's drug safety crisis has a closely-knit relationship with current incomplete laws and regulations.The Law of the People's Republic of China on Drug Administration(hereinafter referred to as the "Drug Administration Law")is a law designed to strengthen drug supervision,safeguard the quality of medicines and maintain the safe use of the human body.Since the implementation of the drug administration in 1984,it has been revised three times in 2001,2013,2015.In recent years,with the continuous expansion and continued deterioration of our children's drug safety issues.Revision of overall adjustment around the management of drug three times,no special regulation involved to ensure the safety of the children's medicine,it is difficult for children's drug safety to provide comprehensive and effective maintenance.In this case,this article with a perspective of improvement of"Drug Administration Law",from the cause of children's drug safety issues as the starting point,respectively from the supervision of drug regulatory,drug research and development,drug quality standards,recall to study how to achieve the purpose of ensuring the safety of children's drugs by improving the current "Drug Administration Law".In addition to the introduction and conclusion,this paper is divided into four parts,the first part is the basic theory of children's drug safety.This part mainly defines the meaning of the safety of children's medicines and children's drugs,and combines the typical cases of children's drug safety problems,reflects and analyzes the children's drug safety problems,discusses the causes of safety problems,and puts forward the main factors that affect the safety of children's medicines in China;The second part is the present situation and existing problems of the legal regulation of children's drug safety in China.This part is mainly based on the content of "Drug Administration Law",discusses the situation and existing problems of supervision of children's drugs in China,drug research and development,drug quality standards,recall of the legal system;The third part is the comparative study of children's drug safety legal regulation.This section mainly selected the United States and the European Union,it conducts a specific analysis on children's drug safety protection legislation and the maintenance of children's drug safety,to explore how to protect children's drug safety in the advanced countries and organizations;The fourth part is the perfection of the legal regulation of children's drug safety in our country.This part,after the first three parts,puts forward how to perfect the "Drug Administration Law"from the four aspects of the supervision of children's drugs,research and development,quality standard,recall so as to achieve a purpose of ensuring the safety of children's medicines with more scientific,comprehensive and effective means.
