With the development of market economy,China is in a period of comprehensive transformation,the diversification of social organization needs a large number of high-quality workers and technician.The State Council published "the decision on accelerating the development of modern vocational education " in June 2014,proposed to develop modern vocational education.It is necessary to increase the proportion of teaching practice in practice,so that "unity of knowledge and practice" to create a new Internship model.However,with the increase of the number of internships,school interns suffered more damage due to frequent cases,school interns are vulnerable groups,labor relations can not be identified so that they are difficult to defend.Every year scholars call for the law should be perfect,should clearly defined the labor relationship,which is not a fresh topic,but the result is still unable to follow.This paper based on the basic concept of internship practice,clarifies the legal relationship between the school,the student and the internship unit,clarifies the labor relationship during the internship,and provides the theoretical basis for the responsibility of the internship in our country.This paper mainly includes four parts:First,the Introduction introduce the research background,the research purpose and the research significance and the method;Second,the main case and the judgment result;Third,the case controversy focus analysis;Last,reflections on the determination of Labor relations in school students.Through the four parts of this paper,it is necessary to explore the problem of the identification of labor relations in the school internship,which is conducive to further analysis of the legal relationship between the labor force in our country,and to solve the labor dispute,To arouse the school workers in the labor relationship that the issue of attention,clear the internship in the labor relationship between the specific standards,to maintain the authority of the law,so as to create a suitable environment for the current good atmosphere.
