Research On The Criminal Law Regulation Of Child Abuse

The amendment to the criminal law of the people's Republic of China(nine)amended260th articles of criminal law,which stipulated that the victims were unable to tell,or could not carry out the case because of coercion or intimidation,and could be turned into public prosecution cases.In addition,the new one of 260 th in the back,will have custody and care responsibilities of the people to implement severe abuse behavior in the criminal punishment scope,effective to fill the legal gaps of non criminal abuse of family members.This article is the legislative status to the criminal regulation of child abuse behavior as the basis,analysis of some points exist in the judicial practice of the crime problem,find out the suitable for China's basic mode of the social status of the current criminal law,the comprehensive protection of children considered from the point of view,fully protect the legitimate rights and interests of children.This article is divided into four parts,the specific content is as follows:The first part introduces the crime of abuse,abuse of guardianship,caregivers of crime of child abuse behavior of constituent elements of child abuse cases involved in the crime of abuse,abuse of guardianship,caregivers of crime and the crime of intentional injury and make a comparative analysis.The third part,through consulting other countries and regions related criminal laws and regulations,to Germany,Japan,Hongkong region criminal law on the crime of child abuse regulations were combed.The fourth part is to rethink the criminal law regulation of child abuse,and propose to improve the implementation system of criminal law,and standardize the understanding of "bad plot" and so on.
