A Study On The Settlement Mechanism Of Litigation In Tourism Disputes

At present,with the rapid development of tourism economy,along with the substantial improvement of material living standards,people's demand for tourism continues to increase,resulting in the rapid increase in tourism tort disputes.Especially in recent years,a high degree of concern "Extortionate price of seafood" in Sanya and other representative event tourism disputes emerged endlessly,continuously went against the interests of tourism consumers,and caused extremely bad influence to the healthy development of local tourism,and a loss of interests,which seriously affects the harmonious development and prosperity social stability.But the existing tourism dispute settlement mechanism in China has not yet formed,the existing one is obviously not suitable for this kind of dispute,therefore it is necessary to perfect our existing dispute settlement mechanism to adapt to the new types of disputes.According to the existing dispute settlement mechanism in China,there are some ways to resolve the disputes in the litigation and litigation,but it is rare to solve the disputes in the case of litigation.The fundamental reason is that,for the special tourism disputes,litigation has a lot of limitations.Since tourism disputes litigation is not the best choice,we should seek a set of optimum solutions in the tourism disputes out of action plan,to provide new theoretical reference for efficient and timely solve the existing tourism disputes.Tourism disputes litigation settlement mechanism is very necessary for tourism in such cases into the proceedings before the split,through reasonable and effective action mechanism of court cohesion,can be combined as well as a complete set of diversified tourism dispute resolution mechanism,and it is better for the development of China's tourism and provide a theoretical basis for settling disputes.Especially the Supreme People's court in June 28,2016 issued the "people's Court on further deepening the reform of the diversified dispute settlement mechanism",to explore our country's tourism disputes litigation settlement mechanism specified in the direction.This paper takes tourism disputes litigation settlement mechanism as the research object,through the process of popular travel astronomical events and tourism infringement,forcing tourists frequently shopping phenomenon as the starting point,a reflection of our country's tourism disputes often appear in the problem.On this basis,this paper introduces the basic content of the settlement mechanism of the dispute settlement mechanism,and summarizes the status quo of the settlement mechanism.Based on the deepening of China's tourism development of alternative dispute resolution mechanism of the advantages and disadvantages of analysis,summed up the difficulties our country faced in the process of litigation,and then starting from the current actual situation,combined with the development of China's tourism situation,putting forward a few points on the improvement of our country's tourism disputes settlement proceedings the mechanism of thinking.
