With the rapid development of Internet technology,network transactions become an important part of the current market economy.But in the development process of network transactions,the legal system is not perfect,the problem of virtuality,openness,information asymmetry and the Internet itself,there are a lot of unfair competition caused the network transaction,serious damage to the legitimate rights and interests of consumers.However,from the current legislation for the regulation of unfair competition in the network transactions is mainly by the "anti unfair competition law,the law on 1993 implementation of the acts of unfair competition standard is outdated,and the current situation of the development of the electricity supplier is not adaptability,can not completely solve the current the problem.Therefore,in February 22,2017,the State Council put forward the"deliberation on the draft of Anti Unfair Competition Law" amendment bill in the twelfth session of the twenty-sixth meeting of the NPC Standing Committee,the revision is the law for the first time since the implementation of the revised.The revised provisions of the new economic situation,there are more regulation of unfair competition,but not perfect.Only increased fourteenth as a special regulation of unfair competition of the network based on network and unfair competition behavior in the form of expression is more complex,for example,network transactions in the praise back now,fictitious transactions and other acts cannot be included in the new fourteenth regulation range,makes this kind of behavior is still not clear the supervision and punishment basis.This article mainly aims at the unfair competition behavior in the network transactions,based on the connotation,improper behavior in the network transaction characteristics and forms of derivative analysis,combined with China's status quo of the legal regulation for acts of unfair competition in the network transaction and the existing problems,through the legal system of foreign exchange regulation network unfair competitive behavior,put forward in the legislation of the current law to strengthen and perfect,to provide a legal basis for solving the unfair competition of the network;strengthen efforts in law enforcement,clear law enforcement subjects;in judicial practice to make clear the scope of the jurisdiction,enhance the effect of practice.From these three angles to improve China's legal regulation of unfair competition in Internet trading.In order to better meet the needs of the development of the trade of the network,a good and fair competition environment for the development of the market network construction,protect the legitimate rights and interests of consumers,promote the socialist economic development goals and fast.
