The Internet has become an indispensable part of our lives,which not only facilitates our lives,but also greatly promotes the development of the modem economy.However,it should not be overlooked that in recent years,some new ways of unfair competition have emerged under network conditions,which are damaging the rights of other operators and consumers,and affecting the fair competition order of the market.How to regulate this unfair competition behaviors under network conditions have become an urgent problem to be solved.In this regard,although China's current legal system is also involved,overall,there are still many deficiencies and difficulties,such as the lack of comprehensive protection of interests,the lack of clear definition of competition,and fewer judicial avenues.And as the regulatory body is not clear enough to address law enforcement issues;there are difficulties in the collection of evidence,disputes over jurisdiction and other judicial aspects.In the face of the above problems,it is necessary to comprehensively improve the existing legal system based on the analysis of the characteristics of unfair competition behavior under network conditions and the experience of foreign legislation and justice.That is to say,in terms of legislation,it is necessary to expand the object of interest protection,clarify the definition of competition relations,improve relevant legal responsibilities,and broaden the channels of judicial relief;in law enforcement,it is necessary to further clarify the authority of the supervisory body and establish a "blacklist" credit.The platform system,the technical prevention mechanism for establishing unfair competitive behaviors in the network,etc.,in the judicial aspect,improve the evidence collection mechanism,clarify the division of jurisdiction,improve the level of judicial services,and provide a good legal guarantee for maintaining the network economic order in China.
