Webcast is a new form of network media that can synchronize real life scenes,based on broadcast software and mobile applications.In the recent years,live webcasts have rapidly become an emerging popular online virtual industry.Especially the mobile ones,they cover all broadcasting forms and have become the main trend of future network broadcast industries due to its typicality,influence,right of speech and benefits.Due to its high speed and wide access,a webcast is likely to spread live culture as well as conceal potential illegal crime,which is convenient for facilitating anonymous and transnational crime.Thus,it is difficult to regulate and enforce webcasts.Currently,China has not yet issued a clear law and regulation regarding webcasts.Therefore,law enforcement supervision is not available and applicable at the moment.Webcast has its own characteristics which demands the adjustment in law edition and supervision.Also,it influences the constitution,the criminal law,civil law,economic law and other legal fields.For example,we have to apply the constitution by balancing some extent of freedom of speech as well as encouraging cultural prosperity.In this way,we can avoid spreading negative information and preventing social risks.Besides,the inefficient performances of webcast laws can lead to copyright disputes and increased risks in webcast market.Furthermore,it can cause unfair competition and tax issues.Although our country has relevant legal norms,the lack of efficiency,self-discipline mechanism,supervision and being systematic still needs to be improved.Therefore,it is imminent to regulate the network broadcast industry.In order to deal with it,there are two aspects which require thorough consideration.Firstly,we need to establish a legal system which can clarify its related rights and develop the capability to protect the network platform.Secondly,we should strengthen law enforcement,and the government is supposed to play a leading role in themanagement and service to promote a positive development of the network industry.In order to solve the above problem,the author compared common aspects of webcast regulation in some areas.Especially the EU,the US,Japan and South Korea.Based on this finding,we could critically absorb useful experiences in laws and regulations,policy procedures,self-discipline and social supervision for the webcast industry.This paper is dedicated to clarify and discuss different aspects of webcasts in legal system.Furthermore it offers the following solutions which regulate webcast effectively.Firstly,it is imminent to establish a perfect legal system to regulate the current webcast industry.Secondly,it is recommended to explore an effective mechanism for governmental regulation over webcast industry,supervising the content and allowing the extent of freedom of expression,based on social ethics.Thirdly,it is practical to encourage autonomy and development of self-discipline management mechanism through confirming its legal status.Fourthly,it is essential to develop a rewarding system for public supervision.Fifthly,co-operations with international organizations cannot be neglected in that government,since the society and individuals all play important roles in making the legal system into effect for the better development of webcasts.
