Research On The Criminal Law Regulation Of Network Porn Live Broadcast

The arrival of the network and the development of network technology have brought many challenges to many aspects of the traditional criminal law theory.Facing the new form of cyber crime,the hysteresis is reflected more obvious in the criminal law,which indirectly makes lot of illegal crime popped up when faced with huge benefits of Pornography crime.Webcast is a new type of network media that has emerged I the past two years and rapidly occupied the market and the public's attention.With the development of live broadcasting industry,the porn live broadcasting is also a new type of network porn crime mode.Compared to the traditional crime,the porn live broadcasting could cause more harm than the traditional crime,due to it speed and range and faster.Many people think that China's traditional criminal law cannot bear the burden of preventing and punishing crimes when it faces this kind of new crime mode.From the perspective of China's criminal law,this paper discusses and analyzes the regulation of network porn live broadcast,in order to solve the difficulties in the application of criminal law in the practice of network porn live broadcast.This paper also focuses on the identification of the charges and the analysis of typical cases for discussion.At present,China has not yet issued a special law to regulate the webcast industry,and the industry applicable legal forms are not clear enough,also no provision has been made for the protection of minors.The criminal law is ineffective in regulating online live porn.All these remind us of the need to perfect the relevant criminal legislation to behave live broadcasting industry,and to protect the physical and mental health of minors.For the development of network broadcast,it needs to be well constructed and managed,so as to maximize the positive energy contained in network broadcast.
