| The thesis focuses on the Case of World Luxury Association v.Beijing News and Southern Weekend,analyzing the basic reasons of the two media companies’ defeat and win in different court trials.It explores the vital legal issues related to this case,which include whether the defamatory news pointing to the plaintiff,the allocation of burden of proof,how to decide whether the reporting content are truth and how to protect the anonymous source.The thesis is aimed at taking the case as an example,giving in-depth analysis of the media defamation lawsuit,especially the risks caused by using anonymous sources in news reports.This paper is divided into four parts.The first part introduces the research background,the research significance and the research method,giving the literature review and pointing out the difficulties and innovation of the paper.Bringing the problem of protecting anonymous source to the surface,this case is seen as the top ten influential litigation in 2015,which draws wide social attention,especially in media and legal sectors.The second part explains the basic situation of this case,including the facts of the case,the legal issues involved and the court decision.The third part points out that the key reason leading to media’s winning in the second instance is that the anonymous news source showed up and gave testimony.We can see that whether the reporting content is true really matters in this case,influencing court making a different judgment.We should pay attention to the defining standards of the truth of news and the risks brought by anonymous source.This case is called the first media infringement case involving anonymous source’s role as witness at court.Keeping secret for anonymous source is the basic journalism ethic,while in the face with legal issues,how to deal with the problem of protecting anonymous source has always been troubling media.This paper discusses related questions and analysis the tendencies of different countries in dealing with this problem. |
