The Study On The Will Regarding The Real Estate After The Demolition

Inheritance is divided into two ways of statutory succession and testamentary succession.Statutory succession is conducted according to the scope and the sequence of the law;and testamentary succession is conducted according to the property owner,reflecting the will of decedent,priority to the battery.However,once the subject regarding the testamentary succession changes,and the formalities are not uptated in time,the dispute will appear when the inheritance occurs,leading the beneficiary and other legal heir holding different views.This thesis chose the will on real estate,and analyed the legal effect of the two wills set by the decedent,discussing whether the effect of the will was still valid after the house demolition.Through the analying of the effect of two wills,the changes of the subject before and after the demolition,and the disputes of the case,this thesis hopes to reflect the flaws both theoritically and practically,and also hopes to put forward some feasible suggestions on the perpection of the testamentary succession processing rules.
