Research On The Infringement Of The Right Of Communication Through Informationnetwork Of Film And TV Works

Although the development of the Internet in China is relatively late,but the development speed of the network has made it no longer a new thing.The Internet is a no geographical restrictions,no time limit,you can share anything anytime,anywhere.Of course,any development of things too fast will have some drawbacks,although the information network provides a large amount of data to the public,but also is a part of the public rights infringement,infringement cases more prominent is the film and television works more and more.In this paper,the author makes a systematic exposition of the problems involved in the protection of the right of information network dissemination.The first part of this paper is introduction,mainly explains the concept of the right to network dissemination of information,and then come out of the film and television works information network transmission right understanding of features,including film and television works information network transmission right of information network dissemination of film and television works in the form of film and television works and infringe the right of information network dissemination behavior pattern.The second part mainly from China's current legal and judicial practice of the two aspects of the existing problems,including the jurisdiction of the court,it is difficult to determine violations of film and television works information network transmission right of compensation standard is not reasonable,four aspects have to provide search,limitations and difficult to determine the main link of direct infringement cognizance the subjective fault.In the third part,the author puts forward the corresponding suggestions for the existing problems in the second part,and puts forward how to strengthen the protection of the copyright of the film and television works from the perspective of the obligee.
