The Research On Personal Information Of Personality Rights Protection Modal In The Big Data Era

The research on personal information protection modals have been the hot topic in academic world.As the development of society and improvement of technology and science,big data and cloud computing technology are getting maturer,which leads to greater risks of leak and abuse of personal information.Therefore,it's necessary to build the theory on personal information protection.By comparing the advantages and disadvantages of protection modals in privacy right,personal information self-determination right,property right,and authentic right,the author suggests to build unified legislation from the protection modal of Personality Right while using centralized legislation and decentralized legislation as reference and combining with the features of theory and practical operations in China.The author also suggests that personal information right shall be notarized in the Civil Code of Personality Right,and be detailed in Act on the Protection of Personal Information in the future.By doing that,personal information will be included in the general personality rights.By using personal information right as the transparency provision,the explanation from judge and justice as reference,and the theory of personality rights as judiciary relief,the conflicts between personal information protection and public interests will be better balanced,as will the conflicts between personal information and social benefits.
