The Study On Public Participation In Administrative Legislation Of South Korea

Public participation has become a requirement in the field of administrative legislationin today's political life,citizens are increasingly concerned about if the legal process of the source of the legislation is legitimate,their willingness to be taken into account.The Public participation is of great significance to the legality,democracy and scientific construction of administrative legislation.This paper studies the content of public participation in administrative legislation in South Korea,on the basis of the development background and the specific system form of public participation in administrative legislation in South Korea,and analyze its advantages and problems,in order to find a way to promote public participation in the administrative legislation of our experience and reference.Since the promulgation of the administrative procedure law of the Republic of Korea in 1996,after 20 years of development,South Korea has got a large number of legal and democratic elements for its government legislation.South Korea's public administrative participation system legislation mainly includes the administrative legislation system of public notice,comments and analysis system,and hearing system,which can be found in the law document in South Korea.Due to the sound legal system is the need to practice the process of inspection and inspection,it will show a lot of deficiencies,the public participation system in Korea as well.Especially with the popularization of communication,information and mass media,the public's direct participation in political and legislative activities is increasing,and the participation of the people in the country has increased.Based on the general theory of public participation mechanism in the process of administrative legislation,this paper puts forward some opinions on the basis of the analysis of the present situation of public participation in administrative legislation in South Korea.Hope to provide a theoretical contribution to the construction of public participation mechanism in the process of administrative legislation.In March 2015,China amended the legislative law,and the revised legislative provisions increased public participation in legislation.The public participation in the legalization of administrative legislation,scientific and democratic new requirements.The author puts forward his own views on the new problems of public participation in administrative legislation.This paper is divided into four parts:the first part describes the background of the development of administrative legislation in South Korea.The second part introduces the system of public participation in the process of administrative legislation.First elaborated the South Korea in the legislation of public participation in legislation,and then to a representative of the legislative procedure of administrative system of South Korea in the administrative legislation system and feedback notice system for a detailed introduction.The third part puts forward the problems in the process of public participation in the administrative legislation on the basis of the second part,and then introduces the improvement scheme of these problems.The fourth part introduces the current situation of public participation in administrative legislation in China and puts forward some solutions to these problems.
