Study On The Regulation Of Local Legislative Power In Our District

On March 15,2015,the legislative law which was revised was enacted formally.The legislative power was conferred to all the city which divided into districts.This has aroused widespread concern and discussion in the community.After nearly two years of legislative practice,many problems are exposed in the process of legislation.A variety of potential risks were sharpening.In view of the outstanding problems,how to effectively control is crucial.On the basis of system analysis,this paper made a further outlook on the possible problems of local legislation,and put forward the corresponding system design to solve the problems in order to benefit our socialist legal system construction.Firstly,this paper analyzed the historical development and practical significance of the local legislative power which granted to the city divided into district.Next,through the investigation and study of the city which had already exercised the local legislative power,this paper made a detailed analysis on the possible problems in the practice of legislation and summed up the crux of these problems.Such as the lack of scientific and enthusiasm,the departmental interests and local protectionism,low quality of legislation,cross-regional legislation conflict and repeated legislation,the misuse of legislative interpretation power and so on.At last,the paper put forward the path to improve the local legislative power.We can make efforts from the following aspects,careful evaluation,the leading of The National People's Congress,scientific legislation,and enhanced scrutiny.I hope this paper can be helpful to our country's local legislation practice in the future.
