Research On Local Legislative Power Exercise Status In Cities Of Districts

In order to implement the reforming policy of managing the country according to law and establish legal system of socialism with Chinese characteristics.On March 15,2015,?the People's Republic of China legislative law?(hereinafter referred to as the new "legislative law")was modified.According to the new?legislative law?article seventy-second and article eighty-second,the Municipal People's Congress and government of cities divided into districts,can develop the local laws and regulations of urban and rural construction and management,environmental protection,protection of history and culture,etc.,combining with the actual situation of the administrative region.It also gives 273 cities divided into districts(including 30 autonomous prefectures and 4 prefecture level cities without districts)local legislative power,expands local legislation in the scope of subject as well as improves China's legislative system,which further promotes the process of rule of law in China.Since the promulgation of the new?legislative law?,in order to undertake local legislative power,all cities make preparation actively and work tensely.In this paper,the author takes Shaanxi Province as the sample,uses the empirical analysis method,makes field research in ten cities divided into districts within the jurisdiction of the Municipal People's Congress Law Committee and the government office of the legal system.Through data collection,seminars and other forms,the author communicates with the local legislative front-line staff and understands the general situation of the local legislative exercise.Through the understanding of the current situation of the exercise,the city from the organization to staffing,from the system to the development of the plan,from the legislative expert appointment to the legislative work training,all the works have made pioneering achievements.However,at the beginning of legislation,the legislation itself has the complexity,so the local legislation work in every cities still have problems,such as lacking of a thorough understanding of legislation,the legislative body is not complete,lacking of legislation concept and understanding,legislative requirement collection is not standardized,legislative expert consultant system is not in place and imperfect legislative supervision.In order to improve the ability of local legislation,improve the quality of local legislation,and ensure the effective development of local legislation,we need to study carefully and adjust in time.Aiming at the existing problems,I suggest,firstly,clarify the relevant legal issues,improve the understanding of the legislative body to the local legislation;secondly,strengthen the construction of the legislative team,overall plan the local legislation;thirdly,perfect the mechanism of the collection of legislative demands,the legislative work system and the expert consultant system;fourthly is to improve the quality of legislative training,from three aspects including training subject,training content and training method to achieve accurate training.
