| With the increase of foreign economic exchange,establishing a steady and efficient admittable regulation in foreign capital has been the international consensus.As the core content,Negative list indicates the tendency of foreign capital management.On the one hand,in 2015,the BIT negotiation between China and the USA has entered a substantial phase which is featured by Pre-establishment National Treatment and Negative list.On the other hand,with the slowing of the economic growth,the bonus from reforms need to be released further,and the big four free trade zone need to be improved in depth and breadth.So,the Negative list rules is the important measure of dealing with the Liberalization of international investment and establishing the foreign capital management mode with Chinese characteristic.And it is also the necessary way of constantly deepening reforms and carrying forward the One Belt and One Road strategy.Picked the Tianjin free trade zone as an example,this paper analyzed the Negative List in three aspects.In the part one,this paper told the Negative List's concept,origin,development,legal basis,features and realistic significance to China.In the part two,this paper made a detailed analysis on the Negative List of Tianjin free trade zone and found that Tianjin's Negative List is lack of legal supports,its content quality is not high,and the government's power and responsibility is not clear.In the part three,this paper researched some foreign examples of the negative list and put forward some suggestions for Tianjin free trade zone's negative list based on above-mentioned experiences.First of all,the laws about foreign capital need to be modified thoroughly.Secondly,we must to improve the quality of the Negative List,and make it accord with the international prevailing rules.Finally,we should reserve the powers for revise and explain the Negative List,the government needs to change and improve the way of management,clarifying the responsibility of supervision. |
