Study On The Negative List Of Foreign Investment Admission In China Free Trade Pilot Zone

The world economy enters the post-financial crisis era,the globalization of investment has attracted worldwide attention.Among the principles of the international investment,the Free Trade Zone(FTZ)has become one of the most important ways for countries to attract foreign investment and capital.Since the Shanghai FTZ has established,the Negative List has first put in action in China's FTZ.The Negative List means to promote development of FTZ by openness.And nourishes the formation of economic development via attract foreign investment.From 2013 to 2018,China's Negative List has undergone five versions of Negative List reform,the Negative List has gradually become the prior rule in the rule-making process.Because of inexperience and starting late in foreign investment admission,China has to learn from the experiences of other pilot free trade zones.Generally speaking,China has to continue the reformation of Negative List,which is meaningful to the development of free trade pilot zone.The paper is divided into four parts:To start with,the first part introduces the conception of Negative List.Negative List,which means a country has set several measures to constrain foreign investors'behavior in the process of foreign investment access.Negative List indicates the country reach the high level in free trade.The government has to release unessential power to spur the vitality of the market.And foreign investors can do business where they want to invest if the Negative List permits.The host country will give foreign investors Pre-National Treatment if their project is out of the Negative List.And they are rely on each other.In the international investment,Negative List and Positive List is a couple of contrary conception in the international investment,and there are numerous countries adapting Negative List to regulate foreign investment access.The second part demonstrates the evolution of Negative List,and summarize several problems in the practice.The Special Administrative measures have decreased from 190 to 48 now.The Negative List has simplified and optimized in specific measures.However,there are still some problems in the Negative List,such as docking international standards,openness.There are lots of restrictions in service industry,manufacturing industry and other industries.Inaccuracy expression of Negative List and over-revised version make the transparency and stability in vague condition.and it also lack of legal support.The third part investigates the implementation of negative lists in foreign free trade zones,and analyzes the achievements they have made.It mainly studies the negative list of foreign investment access in New York Port,Yurong,Dubai Jebel Ali and Manaus Free Trade Zone.New York Port's Negative List meets the international high standards,and Jebel Ali Free Trade Zone has attained advanced opening foreign investment access policies,As well as Yurong Free Trade Zone and Manaus Free Trade Zone,and both of them are well-equipped with soundly legal system to support the development of Negative List.The fourth part puts forward several suggestions to optimize the Negative List of China in FTZ.In order to enhance the degree of openness of Negative List,China has to keep path with international standard of the categories establishment,and to remove and broaden the restrictions in service industry and foreign admission.Promotes the transparency and stability of negative list by accelerating its expression.Meanwhile,clarify the legal status of Negative List to improve the relevant measures.At last but not at least,speed up the implement of Foreign Investment mechanism and promote the development of Negative List.
