The Research Of Infringing Personal Rights Of Criminal Justic Recovery Subject

The recovery subject has played a vital role in criminal justice for Infringement of personal rights.It is the initiator of the recovery process,but also by the recourse,the scope of the recovery and the amount of the identified,it is the implementation of judicial recovery.If a system has no organs to implement or not a good rule by whom the implementation,it is so difficult to implement and to play its due effect.Therefore,the refinement and perfection of the main body of compensation is of great significance to the development of the whole system of compensation,and it can also warn the judicial staff to act according to law,from a certain side to reduce the miscarriage of justice and violations of citizens' personal rights behavior.On the basis of combing the domestic and foreign legislative practice experience and related research,this paper puts forward how to better confirm the subject of criminal justice recovery,so as to perfect the system of legislation and recovery in the future,which is based on the subject of reconsideration of criminal justice in violation of personal right.Besides the introduction and conclusion,this paper consists of three parts.The first part is the summary of the subject of criminal justice,and discusses and studies the basic theory of the subject of criminal justice recovery.The second part mainly discusses the problems and causes of the present situation of the subject of criminal justice recovery.The third part is about the refinement and perfection of our country.The third part is about the basic theory of criminal justice recovery,the specific idea of recovering the subject.This part is aimed at changing the single setting mode of the "compensation organ or the subject of compensation",and put forward the idea of establishing the specialized organ as the main body of criminal justice compensation.
