Study On Crimes Of Promoting Terrorism,Extremism,Inciting Terrorism Activities

In order to severely crack down on the crime of terrorism and extremism,"Criminal Law Amendment(9)" newly set up crimes of promoting terrorism,extremism,inciting terrorism Activities.In the face of new crime involves the related concept of the academic controversy,precise definition of its meaning is the prerequisite and the foundation of correct application of the law in judicial practice.This article consists of three parts.The first part respectively introduced the different point of view of terrorism,the extremism and the terrorism concept,and finally draws the following conclusion:Terrorism should be a kind of idea,opinion,and it is not a kind of behavior;the meaning of extremism is an idea or an opinion which deviates from public recognition values and may take any other radical means to endanger public safety adhering to achieve the rejection and elimination of other dissident ideas;four characteristics of terrorist activity should be summarized as cause social panic,destructive and non-legitimate terrorism.The second part analyzes the promotion and incitement behavior from different perspectives,and finally draws the conclusion that the promotion behavior is a behavior which was widely announced and preached for the purpose of spreading terrorism and extremism.Incitement behavior is namely to encourage and instigate others to commit a terrorist attack by the way of persuading,inducing,deceiving.The third part introduces the different opinions of individual,unit,and state subject on terrorism crime,gives a comment on these different views and elaborates the article's opinion,and then come to the conclusion that the subject of the crime should include individuals,states on the level of international law,and the unite is not included.However,it is recommended that the unit should be included in the subject.
