Research On The Criminal Legislation Of Anti-terrorism In China

Terrorist crime is beco ming more and more serious,it has become one of the most serious crimes in today's world,and has se verely disrupted and destroyed the worl d peace and stability,seriously interfere with the normal development of the world economy and challenge the bottom line of human civilization.In order to combat the growing phenomenon of t errorist crime effectively,according to the needs of anti-terrorism,all countries are pu tting priority effort into work on l egislation.Due to the different conditions of countries and the threat of terrorist crime,anti-terrorism legislations of the countries of the world are different.In recent years, China has also suffered a serious threat of terrorist crime,according to the needs of anti-terrorism, China has stepped up the pace of anti-terrorism criminal legislation through the amendment and improvement of criminal law.Because of the complexity and variability of the crime of terrorism,there are st ill some shortcomings in the current anti-te rrorism law,which needs further improvement.Through the analysis and discussion upon the legislation of anti-terrorism in different countries,so that we can provide some help for the improvement of China's anti-terrorism legislation.This thesis consists of introduction, text and conclusion. The main body is divided into four parts:The first part is the definition of terrorism and terrorism crime. First is the conception of terrorism, the confirming of it is the most important aspect of the study of terrorism crime,domestic and foreign scholars terrorism have defined it according to their own understandings. The second is the definition of terrorism crime, because the historical background, position and core values of each country are different,the definition of terrorism crime are also not the same.Finally is the redefinition of terrorism and terrorism crime. Through the analysis of the concept of terrorism and terrorism crime in the legal documents of different countries and regions,trying to find out the core content and basic characteristics, in order t o redefine the concept of terrorism and terrorism crime.The second part mainly analyzes the present situation and the problems of our country's anti-terrorism legislation.First of all,it discusses the present situtation of China's anti-terrorism legislation.It has two divisions:the process and the content.The improvement and modification of the anti- terrorism criminal legislation in our co untry is mainly through the amendment of the criminal law.its contents are mainly contained in the provisions of the criminal law, Counterterrorism Law of the People's Republic of China is also involved in criminal matters.Second,it discusses the problems of China's anti-terrorism legislation. No one is perfect. Through the analysis of the status quo of China's anti-terrorism criminal law,we can find some imperfections are s till existed.Mostly are offense setting unscientific,the legislation are too criminal,the related conception is not perfect and lack of coordination with the special anti-terrorism law.The third part introduces the current situation of foreign anti-terrorism legislation and the lessons.First is the current situation of foreign anti-terrorism criminal legislation.Faced with the fact that the harm of terrorism crime is growing on social and economic order,citizens' personal and property security,the United States,Germany,Russia and other countries according to their own national needs,stepping up the pace of legislation and perfecting the domestic criminal legislation.This part mainly introduces the legislative process,legislative model and its content.The second is the reference to foreign anti-terrorism criminal legislation.Subject to the constraints conditions and other factors,foreign Anti-terrorism criminal legislation is different.Through the explanation of it,trying to analyzes the advantages and disadvantages and finding out the references which we can learn form other countries.The fourth part puts forward some suggestions on the perfection of China's anti-terrorism legislation.In view of the deficiency existing in our country's counter terrorism criminal legislation, it puts forward some reasonable suggestions for its im provement. First of all,it explains and defines the certain conception of terrorism crime which are newly introduced.Second of all,it perfects the existing crime institution.Third,It is prop osed that the anti-terrorism criminal legislation should be criminalized in a "moderate degree".
