Study On Criminal Reconciliation In The Prosecution Phase

Criminal reconciliation in the prosecution phase may keep a balance relationship between investigation for criminal responsibility and safeguard of human rights,improve the efficiency of litigation fundamentally,and achieve the optimal allocation of judicial resources.But in judicial practice,there are still some problems regarding to criminal reconciliation in prosecution phase,first,low application and small influence on criminal reconciliation in the prosecution phase;second,narrow application and single type of cases;third,lack of standard procedures;and fourth,single form of compensation and no unified standard for compensation.Therefore,we should fortify prosecutors with study and research on criminal reconciliation system,otherwise provisions upon procedure of reconciliation conference,and improve its applicable scope by simplifying approval procedures of relative non—prosecution;redefine the scope of application of criminal reconciliation to expand the scope of criminal reconciliation in the prosecution phase;standardize procedures in terms of mode,supervision rules and performance of its agreement on criminal reconciliation in the prosecution phase;through legislation to establish a diversified way of compensation,unified standard for compensation;establish and perfect related system on criminal reconciliation in the prosecution phase,to ensure the normal operation of the system.
