A Study On The Improvement In Legislation On Compensation Of House Acquisition On Stated-owned Land

In recent years,the high frequency of forcible house acquisition on state-owned land in some way reveals the problems in legislation of house acquisition compensation on state-owned land.With such a perception,this thesis is a study on the analysis of the problems and countermeasures in the compensation of house acquisition on stated-owned land.In the first chapter,the author made a theoretical elaboration on the concept,characteristic and some relevant concepts.The second chapter mainly deals with the status quo about the compensation of house acquisition on stated-owned land,and meanwhile demonstrates the problems from the perspective of legislation,which followed up with some countermeasures for improvement in terms with the scope,criteria,method and procedure for compensation of house acquisition.In the last chapter,the relevant systems both in continental law and common law countries are introduced serving as the implication for such improvement in China.Moreover,countermeasures concerning with extension of compensation scope,increase in compensation criteria,improvement in compensation procedure and so on are illustrated,which are intended to solve the problems in compensation of house acquisition in China.
