Credit card is a very widely used payment instrument in China in recent years.Because of its ability to spend overdraft funds and keep safe and convenient,not only it enrich the people's consumption patterns,but also to stimulate the potential consumer demand,and then it promote the development of commodity economy.So more and more people began to use credit card as a payment instrument.However,the credit card also has virtual and electronic features.So,There are many risks in the process of credit card transactions.Compare with the other subjects,cardholder is in a weak position.Their rights are very vulnerable.Now many countries have already promulgated the relevant laws to protect the cardholder's rights and interests.In view of this,this paper focuses on the protection of credit card holders' rights and interests,which is divided into four parts.First,the concept and basic theory of credit card are briefly introduced.There is a legal relationship between the credit card entities and the independent and mutually independent legal relationship.We can master the Preliminary understanding that lay the foundation for the analysis below.Second we discuss the problem of cardholder's "right to know" protecting,responsibility in case of credit card fraud and cardholder's rights of defense protection.Through summarizing and analyzing classic cases in recent years.Analyze the problem we have in the legislative and judicial practice.Compared with foreign country's legislative experience,then put forward some improvement suggestions.Through the discussion on the three problems,in order to protect the cardholder's rights and interests and keep a stable and healthy development of the credit card industry.
