A Study On Administrative Conciliation During Securities Law Enforcement

Approved by the state council and issued by securities regulatory commission Administrative Settlement in Law Enforcement is a major innovation in securities law enforcement system in our country,in the investor protection and market which has practical significance.Growing mature at present,our country securities market,securities supervision task is increasingly heavy,single law enforcement pattern already can not adapt to complex illegal phenomenon in the securities market.Based on the purpose of the present situation of our securities and to protect the interests of the investors,the securities and futures commission the administrative reconciliation as a new enforcement measures of securities regulation is undoubtedly the most sensible and conform to reality needs.As securities administrative reconciliation system was formally implemented in the field of securities in our country,securities administrative reconciliation played an important role in the securities process of law enforcement,the administrative reconciliation system applied in the field of securities also manifests the combination of public law and private law,is of epoch-making significance.Securities law enforcement administrative reconciliation this in administrative procedures used in civil,suggests that current our country's securities in the regulatory process is positive administrative consultation of democratic administration,so the way of China securities regulatory administrative is worthy of encouragement and learning.Though the securities law enforcement reconciliation system still need to continue to accept the practice in the securities market inspection,in order to better solve the illegal cases in the securities market.Paper starting from the concept and the theory of administrative reconciliation securities law enforcement,this paper analyse the British securities administrative reconciliation system as well as the United States are discussed in this paper.On this basis,to our country's securities law enforcement administrative reconciliation to carry on the concrete analysis,careful analysis of Chinese securities law enforcement administrative reconciliation procedure to determine the settlement of pay and distribution.And combined with the related case to discuss China's securities law enforcement administrative reconciliation system operation effectiveness,on this basis,finally to explore the improvement of the system of securities law enforcement administrative reconciliation.
