On The Judicial Determination Of The Crime Of Drug Trafficking

The offense of drug trafficking means the illegal sale of drugs or the illegal purchase of drugs for the purpose of trafficking.The crime of illegal possession of drugs refers to the illegal possession of a large number of drugs.There is a close relationship between the two crimes,in the judicial practice there are often difficult to clearly identify the two issues.At the same time,the introduction of drug trafficking behavior in the drug trade is also more common,and the behavior of reselling drugs is often difficult to clearly identify.This has led to the recurrence of the following problems in cases of drug offenses:The act of drug trafficking;The identification of illegal possession;On the Determination of the Behavior of Intermediate Sale;As well as the intermediary to introduce the sale of drugs identified.In order to break down drug-related criminals,prevent and reduce drug-related crimes,we must address these issues.This paper is a case analysis of master's degree thesis,the author mainly from the following three aspects.The first part of this paper is a case introduction,and put forward two controversial issues in the focus.The second part of this paper is the focus of the controversy of the specific discussion and analysis;In this part,the author first expounded the fact that the defendant does not constitute the crime of drug trafficking,Secondly,it discusses the reason why the defendant constituted the crime of illegal possession of drugs,Finally,the conviction and sentencing of the case are discussed briefly.The third part of this paper is the case of thinking and recommendations,And put forward the author's own understanding and view.
