The high seas marine protected areas is a new means of protecting and preserving biodiversity beyond national jurisdiction,and has received extensive attention and development in recent years.At present,there are a number of high seas marine protected areas of regional practice,great progress has been made in the regime construction and management practice.However,there are many problems with the existing high seas marine protection areas legal regime.After extensive establishment of the high seas marine protected areas,it is bound to have an impact and restriction on the use of marine resources by countries in the International Seabed Area(hereinafter referred to as the Area).The purpose of this paper is to analyze the conflict performance and the causes of the conflict in these two legal mechanisms in order to explore the way to solve the problems,and to promote the development of the high seas marine protected areas regime and to improve the acceptance scope of the high seas marine protection areas.This paper analyzes the conflicts between the two legal regimes by exploring the literature in English and Chinese and explores the deep-seated causes of the conflict by seeking comparative analysis and inductive analysis,to solve the coordination methods.This paper is divided into five parts.The first part is a brief introduction to the legal system of the high seas marine protected areas and the Area,including the scope and practice of the high seas marine protected areas,as well as the Area mineral resources development system and the environmental protection system;The conflict between the Area mineral resources activities led to the conflict of environmental pollution,the Area genetic resources activities,such as the contents of the four conflicts;analysis of the performance of the conflict,the third part began to explore the conflict and the contents of the legal situation,and in the fourth part of the proposed solution,including the establishment of a global high seas protected areas legal regime to strengthen the management of information exchange and cooperation content.Finally,in the fifth part of the impact of conflict on China and resolution strategies,for our country in the sustainable use of marine resources to provide recommendations to safeguard China's maritime rights and interests.
