Study On The Judicial Identification Of The Dereliction Of Duty

The criminal law provisions is very simple on the crime of dereliction.Then it causes many bifurcation and problems about the cognizance of dereliction of duty in the field of theory and practice.At present,due to the Law and practical legal division could not reach a regulation or an agreement on causality for the dereliction of duty,resulting the court mad an unfair decisions.Therefore,this paper select a case about dereliction of duty to study issues about the crime of dereliction by analyzing the case.From the dereliction of duty case about Gou XX point of penetration,this paper analyzes the crime of dereliction.Taking this case as an example,by introducing the milts and dispute focal points.This paper analyzes the dereliction of duty behaviors and judge whether dereliction of duty and behaviors have a causality in crime law.This paper comes to the conclusion that Gou XX behaviors conforms with the dereliction of duty.
