Dereliction Of Duty Crime Research

In recent years,crime cases of negligence of duty in the juridical practice has been increasing continually,which brings the diversification of criminality of dereliction and the complication of the consequence of harm.This makes the identification of the causation of crime of dereliction become a major challenge in the judicial practice,but educational circles and judicial circles have not reached an agreement on the identification of the causation of crime of dereliction yet.Different conclusions will be drawn if taken different theories and judgment methods to settle a specific case,so inevitably,same cases with different results of judgment will also occur.Through a general case that draws forth the divergence of the judgment of causation in the juridical practice,this paper comes to a relatively reasonable conclusion which uses objective imputation theory as the affirming method of the cause and effect of crime of dereliction by expounding the conditioning theory,reason theory,objective imputation theory,occasional and inevitable causation theory and many other Chinese and foreign theories of the law field.Hope that reference functions will be achieved in the process of punishing the crime of dereliction.
