| Taking punitive damaged system,as a live research object,is our long-term as well as immediate needs of the reality in China.The main theme of this paper Based on the implementation of the system of punitive damages,and caused by private rights relief for commercial and economic activities in the field of ubiquitous tort.To find effective measures which would have possibility in revamping the dysfunctional system of remedy,It's the inevitable to analyze the two in our country,the punitive compensation system and the hybrid administrative punishment system with the value choice model of punitive compensation system,which are characteristics of utility.To fill the loopholes in the rights relief system and to provide a remedy for malicious deeds,It is of great importance to compare,synthesize and induce through investigating and analysising the common characters.However,these legal reviews are worth thinking,confusion of the value choice,lack of commercial loss problem,hot spots of economic and so on.Upon conclusion of the studies,There would be substantial applicable by practicing the value of punitive compensation system selection model,which will be able to deal with the social reality in all kinds of civil and commercial interests,economic interests.As a result,the system of punitive damages will be able to meet urgent need.Further more furthermore,nothing is not comprehensive,not convenient or invalid in the legal relief. |
