The Legal Issues And Completion Of Offenders Released On Parole In Our Country

The parole system as an important part of the penalty execution system,could prompt the offender to observe the prison rules seriously,maintain the normal management order of the prison,promote the reform of offenders and help offenders return to society as soon as possible.The parole system is not only a matter of judicial practice,as well as a theory of Justice.Along with the development of economy,polity and culture,the parole system in its running process has existed many problems,including parole system in legislation and the application of the parole system.There is a bad need for active exploration of penalty execution system,analyzing the causes of these specific problems and finding a way to resolve.Also,on the basis of learning useful experience from other countries,to put forward proposals for parole system on legislation and application in China,and to provided a useful contribution to the development of our parole system.Based on the analysis of the theory and the practice of the parole system,in this paper the writer intend to analyze parole's concepts and its problems,and introduce and learn useful experience from other countries,finally provide some reasonable suggestions for perfection of parole system in China from the four parts below:Part I: Firstly define the concept of parole,ensuring full argument be on the basis of the concept.Then describe the parole conditions and procedure,as the upholstery for discussion in the following section.Part II: Analyze the existing problems of the parole system in practice,mainly from two aspects including legislation and the application of the parole system.Part III: On the comparison and analysis of common law and civil law system based on the parole system,to sum up the common points and to extract the useful experience,providing a useful reference for the perfection of the parole system in China.Part IV: Above all on the basis of,to put forward a proposal for the perfection of the parole system in legislation and the application,with a view to help achieve the perfection of parole system in China.
