Research On The Improvement Countermeasures Of Beipiao People's Mediation Work

People's mediation is a kind of non-litigation way to settle disputes with Chinesecharacteristics,which plays an active role in handling civil disputes and maintaining social stability. People's mediation cannot develop healthily without the scientific and effective working mechanism. It would make great sense to optimize and realize unique advantage of the people's mediation mechanism, guarantee the legitimate rights and interests of the people,perfect the mediation mechanism of our country and maintain social harmony and stability confronted with of all kinds of complex contradictions and disputes in social transition period.Beipiao City has established a large ‘4+1' mediation system which combine together civil mediation, people's mediation, administrative mediation, judicial mediation and supervision of the petition in order to build a better platform to resolve civil disputes. The people's mediation is the foundation of the "4+1" system, and also the important way and effective method to resolve the grassroots disputes in Beipiao, which has made important contributions to the construction of Beipiao city's safety. However, the continuous development of social economy in Beipiao and people's legal consciousness, as well as the imperfection of people's mediation mechanism are challenging people's mediation unprecedentedly and declining its status in the hearts of the masses, this is manifested in the decreasing number of disputes accepted by the people's mediation organizations.This paper is based on the related theory of the people's mediation and introduces the development situation of the people's mediation in Beipiao city, the organization and the operation of the work,it grasps the current situation of the people's mediation in Beipiao city as the whole,then use the method of literature analysis, questionnaire survey and case interview to analyze the problems existing in the people's mediation work in Beipiao.Through the analysis of the questionnaire data and the case interview, we discovered six major negative aspects that listed as follow: the strength of People's mediation team in Beipiao city is weak; the file formation of people's mediation is irregular; the mediation type of mediation committee is simplex; the grass-roots initiative screening level of mediation organizations is not strong enough; the working enthusiasm of mediators is not high; the status of people's mediation in the minds of the masses is not high; the work intensity of mediators is at high level. Combined with the actual circumstance of Beipiao city and the current situation of the people's mediation, through accessing to information, collating, andanalyzing the data, we summed up five reasons for problems above: First, the enter threshold of people's mediators is low and the stipulations are vague; second, the legal effect of the people's mediation agreement is weak; third, the people's mediation system is not complete;fourth, the fund of people's mediation work is not sufficiently guaranteed; Fifth, propaganda of the people's mediation is not enough and its publicity techniques are simplex.By introducing the ADR model in the United States and Singapore as well as people's mediation operation modes in Shanghai and Chifeng, based on the current economic, political,historical background and other aspects in Beipiao City, with the purpose of promoting the development of people's mediation work in Beipiao city,we put forward a series of improvement measures focusing on three aspects: the improvement of the existing system,increasing financial support and protection, the reinforcement of people's mediation and supervision system.
