Research On Legal Problem Of Security Right On Benefit Right

Benefit right is a new wealth form and independent rights differentiated and indepententized with the social and economic development.At present,financing activities based on the Benefit right mortgage or pledge is flourishing,but the lack of relevant theoretical research,legislative norms,leading to them in a disorderly and uncertain state.This paper is problem oriented,the connotation,extension and character of the right to return as the starting point,further analysis of usufruct is the feasibility of the establishment of security interests,eventually settled in to puts forward legislative proposals of perfecting Benefit right mortgage and pledge guarantee.This paper consists of three parts: introduction,body and conclusion,the body has three chapters,the first chapter puts forward the three main problems studied in this paper,the second chapter mainly analysis the concept,the nature of Benefit right and feasibility of setting the security right,because of the difference of Benefit right nature,current legislation system should be based on mortgage and pledge guarantee.the third chapter put forward legislative proposals to improve the Benefit right for security,in the legislative path of Benefit right collateral shall take the form of separate provisions,not included Accounts receivable pledge,shall take formalism doctrine and hierarchy system.
