No matter it is state-owned express delivery enterprise like China Post Express(EMS),or private express enterprises all have shown that China's express market is extremely prosperous.According to statistics,China's express delivery industry's growth rate always higher than 50% in recent years.However,the quality of express services did not increasing with the business volume.In recent years,the questions about the violation of consumer rights and interests has become more prominent,phenomenons like delayed delivery,damaged express,lost express or even personal information disclosure emerging one after another.Strengthen the protection for consumers rights and interests in the express service,is not only conducive to the healthy and sustainable development of express service industry,but also beneficial to the economic transformation and sustainable development of China.Therefore,protection of the rights and interests of consumers in the express service industry of our country is a worthy studying topic for us.This paper is divided into four parts,content is as follows:The first part is an overview of China's express industry.Firstly,the definition of express service and the development of express service industry in China are briefly introduced,then some important features of express service industry in China are summarized by reference data.Secondly,Researching and analyzing the basic properties of express service contract.The second part is an analysis of the main forms of damaging consumers' legitimate rights and interests in express service.It divided into three categories: pre-infringement(including unfair format clause and express delivery companies didn't complete the obligation of warning reasonably)and processing infringement(including express delay,express damage,express lost),subsequent infringement(including personal information disclosure and compensation standards are too low),and using the case analysis method,combined with the study of relevant legal norms system in China,to point out the seriousness of infringement of consumer rights in China's express business.The third part is the analysis of the problems in the protection of consumer rights and interests in China's express delivery service.The author will be attributed these problems to the existing problems of our relevant legal norms,China's poor regulation of express delivery services and the difficulties in the consumer's right protection.and classify all of these problems and analysis each problem in-depth.The fourth part is about the countermeasures and suggestions about protecting the legitimate rights and interests of consumers in express delivery services.This paper offering the corresponding countermeasures and suggestions for the protection of consumers' rights and interests in China's express service according with these problems which mentioned in second part and the third part of this paper,so as to better protecting the consumer's legitimate rights and interests in China's express delivery services.
