Research On Disclosure Duty Of Code Sharing Air Carrier

Code-sharing transport as a means of air transport for win-win cooperation between air carriers,can make air carriers expand their own route network without cost,also can provide more options for air passengers,but because of the air carriers failed to fully fulfill the duty of disclosure under the conditions of code-sharing,it caused a lot of disputes.The United States and the European Union clearly stipulates that the air carrier and its ticket agents must clearly inform the consumer of the code share flight information and the actual carrier's identity in its laws and regulations,or it will be identified as fraud.But our country only make a general provision of the carrier's duty of disclosure from the aspect of principle of good faith and consumer rights protection.In practice,the air carriers' improper performance of duty of disclosure mainly due to the trouble of computer reservation system,ticket agents do not know or do not inform the code share information,air carriers' lack of effective publicity of the code share flight information,air carriers' ground service agent failed to fulfill the obligation of explicit information and correctly guide and so on.In view of the above reasons,and draw on the relevant provisions of the United States and the EU,we should regulate the implementation of obligations of air carriers under the conditions of code sharing to fully protect the the right to know of vast number of aviation consumers from the following five aspects:the principle of the implementation of duty of disclosure,the subject of the implementation of duty of disclosure,the time and method of the implementation of duty of disclosure,the scope and extent of of the implementation of duty of disclosure,the place of the implementation of duty of disclosure,and thus promote the level of China's civil aviation transport services.
