Multinational Environmental Tort In China Legal Regulation

Multinational companies as a high degree of economic and social development of the product,in promoting economic development and social progress has played an important role.In the course of economic globalization,China has made great achievements in the introduction of foreign capital.The influx of a large number of multinational companies into China has promoted the development of China's economy and accelerated the process of China's economic integration into the world economic integration.To a series of social problems,one of the most obvious is the transnational corporations in China's environmental violations,China's environment has a great impact.Not only China,the world,by the multinational investment and business activities caused by environmental infringement cases are not unusual,each country and international organizations are actively studying and exploring the transnational corporations environmental tort law effective legal regulation.This paper discusses the legal regulation of environmental infringement of transnational corporations in China,which is divided into four parts:The first chapter first defines the concept of environmental tort,and then analyzes the behavior of multinational corporations 'environmental tort from the perspective of the profit-taking nature of transnational corporations and the weak control of the host country.Finally,by introducing the current situation of transnational corporations' environmental impact in China To explain the necessity and urgency of regulating the environmental infringement of transnational corporations in our country.The second chapter introduces the legal regulation system of environmental infringement of transnational corporations in China from the three perspectives of constitution,laws and regulations and local laws and regulations.Although China's environmental-infringement of transnational corporations has the above-mentioned legal regulation,there are still some shortcomings in the existing relevant legislation.It will mainly from the three aspects of the lack of environmental infringing subject,the lack of environmental liability insurance system and the lack of punitive damages system analysis.The third chapter mainly through the regulation of environmental infringement of transnational corporations in international law and foreign law,in the international law more reflected in the adoption of international multilateral environmental conventions to regulate,in the regional investment is selected in the NAFTA on the provisions of the environmental provisions,In the international organization is mainly selected by the Organization for Economic Co-operation on the "transnational corporations code of conduct" on the multinational companies in the investment activities in the environmental responsibility requirements to explore,hope that through the excellent experience can be better to the The Regulation of Environmental Tort in Multinational Corporations in China.The fourth chapter mainly aims at perfecting the legal liability system of transnational corporations' environmental infringement from four aspects,including perfecting the system of environmental tort liability,promoting the establishment of environmental liability insurance system,perfecting the punitive liability of transnational corporations System and other related responsibility system.
