As a global world, interdependence and close connection between countries notonly exhibits in economy but also in environment. The damage humans did to thenature is beyond the recovering capability of the nature itself, leading to the damageof ecological system and threaten to human living.As global economy andtransnational investment prospers, environmental infringement among countriesbecomes a frequent phenomenon. Transnational companies develop businesses indeveloping countries by way of international investment or setting up branches andplants. Industries they embark on are always risky, which cause severe damage to thehost country as well as the local citizens. No legal status of transnational companiesand the specialty in management leads to difficulty for these companies to shouldercorresponding responsibilities over environmental infringement. Considering the factthat it is easy for transnational companies to transfer or avoid their responsibility onpollution, we need to establish and perfect related laws on environmentalresponsibility, which are significant both in theory and practice. Finally, suggestionsto perfect the legal system on environmental infringement are put forward.First of all, legal responsibilities that transnational companies should bear overenvironmental infringement are introduced, where concepts of transnational companyand legal responsibilities that transnational companies take for environmentalinfringement are defined and analyzed.Secondly, legal principle analysis of transnational companies’ legalresponsibilities over environmental infringement are introduced from the principle ofattribution, constitute conditions, implementation model.Thirdly, explain the problems existing in legal responsibilities of thetransnational companies, mainly from the prespecyive of domestic laws andinternational laws.Finally, suggestions are offered to solve the problems in domestic and international laws on transnational environmental infringement.
